France Introduces New Regulations for National Defense and Security: Mobilization of Resources and Personnel

France Introduces New Regulations Allowing Temporary Confiscation of Resources and Personnel in Crisis Situations

In response to growing threats to national security, France has implemented new regulations that enable the temporary confiscation of resources and personnel in crisis situations. The decree, signed by the Minister of Defense, Sébastien Lecornu, allows for the use of key resources and the mobilization of individuals to protect the country from threats, including cyberattacks. It also covers the support of allies in conflict situations, including the transfer of weapons.

The Minister of Defense emphasized that the regulations guarantee the rights of mobilized individuals, ensuring appropriate compensation and full reimbursement for their involvement in defense activities. The new Decree (No. 2024-895 of October 1, 2024) is a key response to the development of security and defense policy, aimed at effectively managing resources and personnel in crisis situations.

France had announced a shift toward a wartime economy in 2022, with the goal of preparing the country to respond to conflicts in the most efficient way possible. The administration is ready to take over factories if the defense industry cannot produce fast enough and has the right to prioritize military orders from companies producing both civilian and military goods.

The new legislation aims to enhance France’s mobilization capabilities through coordinated actions, both domestically and in overseas territories, in preparation for security crises. The changes to France’s Defense Code underscore the state’s flexibility and readiness to respond to threats, strengthening Paris’s ability to mobilize resources in the event of a defense or national security crisis.

The government is prepared to requisition supplies, production lines, facilities, equipment, and personnel to maintain the country’s wartime economy and support its allies. The changes reflect an understanding of growing geopolitical threats and the need for swift state responses in the face of hybrid and unconventional forms of attacks.

France views the security of its overseas territories as integral to its national defense policy, ensuring that territories like French Guiana, Martinique, and New Caledonia are as well-prepared for crises as metropolitan France. The regulations regarding requisitions and crisis-time provisions demonstrate France’s determination to ensure maximum defense readiness.

Overall, the new regulations signal France’s preparedness to respond in times of crisis and highlight the country’s commitment to national security and defense.
